SUMMARY OF MAIN PROVISIONS OF DRAFT SCHEME
(NOT PART OF THE DRAFT SCHEME)
This draft Scheme provides for the union of the benefice of Birstwith Saint James the Apostle and the benefice of Hampsthwaite and Killinghall (their constituent parishes to remain distinct) in the diocese of Ripon and Leeds, for the appointment of the first incumbent of the new benefice and for his parsonage house to be that of the benefice of Hampsthwaite and Killinghall, for the transfer of the parsonage house of the benefice of Birstwith Saint James the Apostle to the Diocesan Board of Finance for diocesan purposes and for the future patronage arrangements for the new benefice.

PASTORAL SCHEME
This Scheme is made by the Church Commissioners this .day of .200 in pursuance of the Pastoral Measure 1983, the Right Reverend John, Bishop of Ripon and Leeds, having consented thereto.
Union of benefices
1. The benefice of Birstwith Saint James the Apostle and the benefice of Hampsthwaite and Killinghall in the diocese of Ripon and Leeds shall be united to create a new benefice which shall be named "The Benefice of Hampsthwaite and Killinghall and Birstwith", and the area of the new benefice shall comprise the parish of Birstwith Saint James the Apostle and the parish of Hampsthwaite and Killinghall, which parishes shall continue distinct.
Archdeaconry and deanery
2. The new benefice shall belong to the archdeaconrv of Richmond and the deanery of Harrogate.
Designation of first incumbent
3. If immediately before this Scheme comes into operation the Reverend Garry Anthonv Frank Hinchcliffe is incumbent of the benefice of Hampsthwaite and Killinghall he shall be the first incumbent of the new benefice.
Place of residence
4. The parsonage house of the benefice of Hampsthwaite and Killinghall shall be the place of residence of the incumbent of the new benefice.
Disposal of parsonage house
5. The parsonage house of the benefice of Birstwith Saint James the Apostle, together with the site and appurtenances thereof and the grounds usually occupied and enjoyed therewith, shall without any conveyance or other assurance be transferred to the Ripon and Leeds Diocesan Board of Finance for diocesan purposes. (It is intended that it will continue to be used for a House for Duty Priest)
Patronage
6. Subject to clause 3 hereof, the right of presentation to the new benefice shall on each occasion be exercised jointly by
Mrs Sarah Jane Finn of 39 Oxberry Avenue, London SW6 3AY, Sir James Alexander Frederick Aykroyd, Baronet, of Birstwith Hall, High Birstwith, Harrogate HG3 2JW, Sir Thomas Colvin William Ingilby, Baronet, of Ripley Castle, Ripley, Harrogate HG3 3AY and the Bishop of Ripon and Leeds in his corporate capacity.
Coming into operation of this Scheme
7. This Scheme shall come into operation upon the first day of the month following the date of any Order of Her Majesty in Council confirming this Scheme.

Clause 1
The church of Saint James Birstwith, the church of Saint Thomas a Becket Hampsthwaite and the church of Saint Thomas the Apostle Killinghall shall remain parish churches of their respective parishes.

'We have sent a copy to all the statutory interested parties, as section 6 of the Pastoral Measure requires, and any others with an interest in the proposals. Anyone may make a written representation (by letter or email) to us either for or against all or any part or parts of the drafts scheme to reach this office no later than THURSDAY 26 FEBRUARY 2004. We cannot treat any communication received after this date as a representation.
If no representations against the draft scheme are received, we will make the scheme and submit it to H.M. in Council for confirmation.
If representations against the draft scheme are received, we will share these with the Bishop, asking for the background to the proposals and seeking his views on the main points made etc.
Interested parties include all the patrons, LEA, Synods etc.
